KnowMe (“KnowMe”, “our”, “we”, “us”) respects your privacy and is committed to protecting your Personal Data. This Privacy Policy (“Privacy Policy”) describes how we collect, use, share or otherwise process Personal Data from job seekers (“Talent”) and parties associated with prospective employers such as hiring managers, career coaches, and recruiters (the “Hiring Party”) when you use KnowMe’s platform: www.video.knowmebest.com, talent.knowmebest.com, hiring.knowmebest.com or our website: www.knowmebest.com, or otherwise interact with us (collectively, the “Services”). This Privacy Policy also informs you of your choices regarding the use and disclosure of your Personal Data.

As used in this Privacy Policy, Personal Data (“Personal Data”) means information that identifies you or your household, directly or indirectly, by reference to identifiers such as your name, identification number, location data, online identifier, one or more factors specific to your physical, physiological, genetic, mental, economic, cultural, commercial, professional, or social identity, or any other such data defined under applicable law as ‘personal data’ (or the equivalent thereof).

By accessing our Service, you agree to be bound by this Privacy Policy. By accessing our Service, you agree to be bound by the Terms of Service (including this Privacy Policy). If you do not agree with our Terms of Service or this Privacy Policy, do not access or use our Service.

Personal Data We Collect

1. Personal Data You Provide Us.

KnowMe collects the Personal Data from Talent when you use our Services such as when you create a profile, upload employment related documents on our platform, fill out a web form on our website, or submit a video. The categories of Personal Data we collect may include:

  • Personal Identifiers such as your name, email address, general location (e.g. city or region), telephone number, password
  • Your social media accounts
  • Any materials you provide to us through your use of the Services such as your username, resume or CV, images and videos that you give us consent to record
  • Any Personal Data contained in a profile you create, content that you post, or in a free text field within a form that you submit to us;  
  • Login or account name
  • AI-generated inferences about you including your skills, abilities, aptitudes, performance at work, interests, reliability, or behavior derived from any of the Personal Data listed above.

2. Personal Data we Collect From Other Sources

Talent may also allow KnowMe to collect personal or job information publicly available on the Talent’s LinkedIn profile or social media accounts.

3. Personal Data that We Collect Automatically.

We use tools such as cookies, pixels, and other similar technologies to automatically collect Personal Data from devices you use while using our Services or interact with emails we may send to you. This information typically includes details about you:

  • IP address
  • Browser type
  • Browser plug-in details
  • Operating system
  • Local time zone
  • Date and time of each visitor request (e.g., web pages selected, and time spent on each page)
  • Referring site and/or search engine
  • Device type (e.g., desktop, laptop, tablet, phone, etc.)
  • Language preference

4. KnowMe as a Service Provider (Data Processor)

In certain instances, the Hiring Party may employ KnowMe to provide services on behalf of a prospective employer. In such case, we process Personal Data under the direction of that client (the data controller) and have no direct relationship with the individuals (data subjects) whose Personal Data we process.

Where KnowMe processes your Personal Data in the capacity of a service provider (data processor), and you want to exercise your data privacy rights, we will provide you with the data controller’s contact information and direct your request to that party.

Our Use of Your Personal Data. We will only process your Personal Data for the following business purposes:

  • To respond to your requests and inquiries
  • To register you as a customer or account holder
  • To provide you with the Services, including connecting Talent with a Hiring Party and sharing of Talent’s Personal Data to the Hiring Party
  • Perform internal operations, such as tracking and improving the effectiveness and security of our Services.
  • For our business purposes such as data analysis, audits, and product development;
  • Personalize user experiences, such as remembering your settings and preferences;
  • To advertise and market the Service such as displaying your content on the public areas of our Service or on other social media platforms;  
  • Comply with legal requirements, such as in response to a subpoena or similar investigative demand.

Our Disclosure of Personal Data. We may share your Personal Data to the following parties:

  • Our Affiliates.
  • Service Providers and Contractors. We use trusted service providers and contractors to help us provide, improve, protect, and market our Services. These service providers may have access to your Personal Data to perform services on our behalf but only as is reasonably necessary for the purpose that KnowMe has engaged them for and in compliance with this Privacy Policy.
  • To Comply with Legal Processes, Protect KnowMe, or Enforce our Rights. We may disclose your Personal Data when necessary to conform to legal requirements or comply with legal process; enforce or apply our conditions of use and other agreements; or to protect the rights, safety, or property of KnowMe, our affiliates, service providers, our users or the public.
  • As Part of a Merger or Sale of Business. We may disclose your Personal Data in connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

In addition to the above, we disclose your Personal Data when you direct us or intentionally disclose your Personal Data to another party. For example:

  • If you are Talent, we will share your Personal Data as follows:
    • If you apply to a job posting on our website, we will share certain Personal Data with the Hiring Party responsible for the job to which you applied.
    • If you have uploaded your resume to KnowMe, we will share your Personal Data with Hiring Parties whom you authorize to access such information.
    • If you are invited to and choose to participate in a video call with a Hiring Party, your Personal Data will be shared with the party that invited you to the call.
    • For any other purpose authorized by you when you provide us with the information or otherwise choose to participate in new features and functions available through the Services.
  • If you are a Hiring Party, we will share your Personal Data as follows:
    • If you invite Talent to participate in a video call, information about your business will be shared with the Talent invited to the call.
    • If you authorize KnowMe to send automated personalized invitations or other communications to candidates on your behalf, we will disclose your business’s identity, general location, and contact information.
    • For any other purpose authorized by you when you provide us with the information or otherwise choose to participate in new features and functions available through the Services.

Opt-Out of Sale, Share, and Targeted Advertising.  We and our third–party partners and service providers (such as advertising and analytics providers) use pixels, web beacons, software developer kits, third–party libraries, cookies, and other similar online tracking technologies (collectively, “online tracking technologies”) to gather information when you interact with our Services. These online tracking technologies are deemed to be a “sale” / “sharing” / “targeted advertising” under applicable U.S. state laws. Depending on where you reside, you can opt-out of these online tracking technologies by emailing us at support@knowmebest.com. Please note, some features of our websites may not be available to you as a result.

Selling/Share of Your Personal Data. We do not “sell” or “share” your Personal Data or use your Personal Data for monetary consideration, but we use your Personal Data for targeted advertising, which may constitute a “sale”, “share” or “targeted advertising”. You may have the right to opt out of the sale, share, or targeted advertising depending on how your state defines “sale,” “share” or “targeted advertising.”

Your Rights. You may have certain rights and choices regarding our processing of your Personal Data. Depending on your jurisdiction, applicable law may entitle you to additional consumer rights, including the right:

  • To know the categories and/or specific pieces of Personal Data collected about you, including the source of your Personal Data, whether your Personal Data is sold or disclosed and the purpose, and with whom your Personal Data was disclosed;
  • To request deletion of Personal Data, if permissible by law
  • To correct inaccurate Personal Data we retain about you;
  • To opt-out of “sale” and/or “share” of your Personal Data, targeted advertising, and profiling
  • To limit the use of your sensitive Personal Data;
  • To nondiscrimination based on the exercise of a consumer’s privacy rights; and
  • To appeal a decision regarding your request

Exercising Your Right to Know, Delete, and Correct. Depending on where you live, you may exercise the right to know (sometime also referred to as the right to access), delete and correct your Personal Data. To do so, please submit a verifiable request by contacting us at [insert email address].

We do not knowingly sell or share Personal Data of consumers under 16 years of age.

Our Retention of Your Personal Data. We will retain your Personal Data for as long as needed to provide you with the Service and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Site-Specific and Additional Terms

  1. Do Not Track Policy. KnowMe does not respond to web browser “do not track” signals.  As such, your navigation of our Service may be tracked as part of the gathering of quantitative user information described above.  If you arrive at our Service by way of a link from a third-party site that does respond to “do not track” requests, the recognition of any “do not track” request you have initiated will end as soon as you reach our Service.
  2. Marketing. By submitting the webform on our Site, you agree to receive marketing materials from us, we collect and use your Personal Data for marketing purposes. You can withdraw your consent at any time by sending an e-mail to marketing@knowmebest.com (iii) Unsubscribe. You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail that you receive from us.
  3. Opt-Out of SMS. With your consent, we may use your Personal Data to get in touch with you by SMS message. We may use phone numbers you provide to send you telephone or text messages about our Service, and such messages may be automatically sent with an autodialer, an artificial or prerecorded voice, or other automation technology. To withdraw your consent to receive SMS messages made using these technologies, simply text “STOP” to these messages.
  4. Links to Third-Party Services. Our Service may contain links to third-party websites, applications, and services not operated by us or on or behalf. These links do not imply any endorsement by KnowMe of the activities or content of these sites, applications, or services nor any association with their operators. KnowMe is not responsible for the privacy policies or practices of any third party including websites directly linked to our Service. You should review any such linked site’s privacy policies before submitting any of your Personal Data to such third parties, as we are not responsible for and have no control over information that is submitted to, or collected by, these third-party sites.
  5. Minors and Children’s Privacy. Our Service is not designed for or intended to be used by individuals under the age of 16, nor do we knowingly collect or receive Personal Data of individuals under 16. If you are not 16 years or older, do not use our Service, including any sites or pages which are integrated into our services, at any time or in any manner. If we learn that Personal Data of persons less than 16 years-of-age has been collected through our Service, we will take the appropriate steps to delete this information.
  6. California’s “Eraser Button” Law. If you are a California resident under 18 years old and a registered user of our Services, you can request that we remove content or information that you have posted to our Services. Fulfillment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user).   7. California’s “Shine the Light” Law. Under California Civil Code Section 1798.83 (the "Shine the Light" law), California residents may request certain information regarding the disclosure of Personal Data to third parties for their direct marketing purposes. KnowMe does not share your Personal Data with third parties for their direct marketing purposes.

Changes to this Privacy Policy. We reserve the right to update or modify this Privacy Policy from time to time. If we make any material changes to this Privacy Policy or the way we use, disclose, or collect Personal Data, we will notify you by revising the “Effective Date” at the top of this Privacy Policy. Users are bound by any changes to the Privacy Policy when they use our Service after notice of such changes has been communicated. We encourage you to review this Privacy Policy regularly to ensure that you are familiar with KnowMe’s current practices.
